Legal & Regulatory Information

Information on this page is provided for general information and does not constitute legal advice. Verify local rules and obtain qualified advice before operating a fireworks business.

Fireworks regulation and licensing

The Explosives Act, 1884 and Explosives Rules, 2008 regulate manufacture, possession, sale and transport. PESO's licensing guidance identifies LE-5 for possession and sale from a shop. Orders placed through Pattasukadai are fulfilled in partnership with Astrocrackers, which holds the licence for the sale of fireworks. Customers may request Astrocrackers' licence details before confirming an order.

Court directions and online orders

The Supreme Court's 23 October 2018 Arjun Gopal judgment directs sale only through licensed traders and states e-commerce websites shall not accept online orders or effect online sales. Whether this site's existing cart to WhatsApp enquiry could be treated as an online order requires legal review; merely redirecting through WhatsApp is not a proven exemption. Joined firecrackers and other prohibited products must not be offered.

Green crackers, noise and local restrictions

Product composition, green cracker status, noise limits, use timing and local bans depend on current Supreme Court, PESO and local authority directions. Tamil Nadu district/municipal/fire authority conditions should be checked before listing, selling, transporting or using products; do not assume national permission overrides a local restriction.

Consumer, pricing and tax

The Consumer Protection Act, 2019 and potentially the E-Commerce Rules, 2020 govern disclosures and grievances depending on the actual operating model. Legal Metrology rules govern applicable packaged commodity declarations including MRP. Displayed prices, any approximately 10% markup, GST on goods or referral/service income and agency status require transaction by transaction legal and tax review; do not misrepresent MRP or commissions.
